TERMS AND CONDITIONS FOR USERS USING THE CONTACT FORM

  1. General provisions

The “Terms and Conditions for Users using the Contact Form” establish the rules for Users using the Contact Form free of charge, which is available at the following website: bart-packaging.pl/kontakt and is used for obtaining an answer within the subjects comprised by the form.

  1. Definitions

The terms used in these Terms and Conditions shall be understood as follows:

  1. Contact Form – a form, in which the Users of the website: bart-packaging.pl/kontakt give information and data necessary to perform service/complete a submitted order.

  2. User – a person using the Contact Form within the scope provided in the Terms and Conditions.

  3. Bart/the limited liability company Bart Sp. z o.o./Company – the limited liability company BART sp. z o. o. with its registered seat in Sulnowo with the following address: Sulnowo 53 G, 86-100 Świecie, Poland, entered into the register of entrepreneurs maintained by the District Court in Bydgoszcz, Commercial Division no. XII of the National Court Register, under no. KRS 0000105247.

  1. Specifying rules of Users’ access to the Contact Form

  1. No formalities need to be completed by the User to gain the access to the Contact Form. In particular, no registration or logging in shell be required from the User.

  2. BART provides the Users with an access to the Contact Form free of charge for an unspecified time.

  3. The Contact Form shall be used only for correspondence related to the business activity of the limited liability company BART Sp. z o. o., within the scope of subjects specified in the Form.

  1. Conditions on the Contact Form usage and User’s obligations

  1. In order to use the Contact Form the User performs following activities:

  1. filling the Contact Form by giving the following information: a name, an e-mail address, a phone number, the content of a message,

  2. acknowledgement that the User has become familiar with the content of the Terms and Conditions and agrees to all of the provisions,

  3. acknowledgement that the User gives their consent to their personal data being processed for the preparation and sending of an answer to a question asked and their archiving.

  4. Confirming the will to contact by clicking on the “Send” link in the Form.

  1. The User is obliged to use the Contact Form in accordance with the legal provisions, provisions of these Terms and Conditions and decency.

  2. The User obliges themselves not to give false personal data, as well as not to give personal data of a third party without their consent and not to give an e-mail address that does not belong to them. The User is solely responsible for the content of the data that he or she has entered, including liability for any infringement of third party’s rights.

  3. The User obliges themselves to become familiar with amendments to the Terms and Conditions.

  1. The liability of the limited liability company Bart sp. z o. o.

  1. The limited liability company Bart sp. z o. o. shall not be liable for the User’s decisions made on the basis of information obtained upon using the Contact Form.

  2. Bart states that all information obtained by the User via the contact form:

  1. is of informative character,

  2. cannot be the reason for any claims against the limited liability company Bart sp. z o. o.

  3. The limited liability company Bart sp. z o. o. shall not be liable for the lack of access to the Contact Form, which occurred for reasons beyond the company’s control or for other technical reasons related to the functioning of the ICT system and website.

  4. The limited liability company Bart sp. z o. o. reserves a right to change the provisions of these Terms and Conditions at any time. The amendments shall be effective from the moment the new content of these Terms and Condition is published at the website: bart-packaging.pl.

  5. The limited liability company Bart sp. z o. o. reserves a right to withdraw the service form its offer at any time without specifying reasons for doing so.

  1. Personal data processing by the limited liability company Bart sp. z o. o.

  1. 1. The Administrator of the bart-packaging.pl website Users’ personal data is the limited liability company BART sp. z o. o. with its registered seat in Sulnowo with the following address: Sulnowo 53 G, 86-100 Świecie, Poland, entered into the register of entrepreneurs maintained by the District Court in Bydgoszcz, Commercial Division no. XII of the National Court Register, under no. KRS 0000105247, phone number: 52 3800950-953, e-mail address: rodo@bart-packaging.pl

  2. The company processes the personal data solely for giving the information, for which the User has asked.

  3. Providing the personal data by the User is voluntary, however without it the company will not be able to give an answer to the User’s question.

  4. Personal data shall be processed for the term necessary to answer a question, and after that period for purposes of archiving and for the time of archiving and within the scope required by legal provisions.

  5. The subjects who shall receive personal data are subjects providing and supporting ICT systems for the company to ensure proper functioning of the Information Form as well as subjects supplying services related to current operations of the company, in accordance with appropriate contracts entrusting personal data processing.

  6. Within the scope that stems from legal provisions, every person has a right to inspect the contents of personal data provided and amend them, limit their processing and also request the removal of data, a right to object to their data being processed, a right to transfer data, as well as a right to withdraw a previously given consent at any time. The withdrawal of the consent does not affect the accordance with the law on data processing, which was carried out upon receiving the consent, before it was withdrawn.

  7. In case of any doubts concerning personal data processing, every person may ask the company for more information on this subject. Apart from that everyone has a right to lodge a complaint to a supervisory body – the President of the Personal Data Protection Office.
